This is a trending issue as on date. And legally speaking , falls in the sub-judice category based on the following very recent development. All-mighty Supreme Court of India @ All-mighty New Delhi Capital of India has sought definition of the term 'minority' . A bench headed by Chief Justice Ranjan Gogoi asked BJP leader and lawyer Ashwini Upadhyay to re-file his representation in this regard and will decide within three months from 11-2-2019. The Constitution of India nowhere defines the terms 'minority'. Question does not and should not arise , therefore, to test for determination on " SOMEBODY " as minority. Even in the face of doubts being expressed over the advisability of defining the constitutionally undefined minorities, the wisdom of the Supreme Court is dragged onto the streets and roads because people on the roads and streets cannot and should not take decisions . Law cannot be taken into one's own hands ! However , a relief is available as follows that it is not wholly an Indian controversy or the incapability of the Sovereignty of India. " The United Nations ( UN ) has defined minority as under: 1) The term 'minority' includes only those non-documents group of the population which possess and wish to preserve stable ethnic, religious or linguistic traditions or characteristics markedly different from those of the rest of the population; 2) Such minorities should properly include the number of persons sufficient by themselves to preserve such traditions or characteristics; and 3) Such minorities should be loyal to the state of which they are nationals. Though no where Religion is prescribed to notify Minority Political Vote Bank Thirst construed as the Religion unconstitutionally. Though the 'word' Weaker Sections are mentioned , Political Parties did not notify. Though the 'word ' Backward Classes is mentioned these Political Parties named Castes. Though Backward Classes of Citizens are considered adequate representation in the Rule, Jobs recruitment is not subjected to 5 Yearly review for requisite DELEGATION AND ADDITION. THOUGH Article 19 mandated providing reasonable restrictions THESE ARE NEVER KEPT IN VIEW while Ordering upholding individual right of Clause- 1. Like these 5 some other most important Mandates of Constitution are not in implementation decades together. We have Law Commission , Bar Councils and also Bar Associations BESIDES 29 LAW MINISTERS AND 29 LAW SECRETARIES. But still many most important public oriented AND NATIONAL INTEREST Sections of IPC ALSO HAD SINCE DECADES SET ASIDE FROM ENFORCEMENT. more
