Suggestion for solving property disputes
There are many property related disputes in society because of which many people live stressful lives for many years. We keep hearing / reading about so many crimes including murders related to property disputes regularly. Courts are also overburdened with such cases. I have following suggestions for the government in this regard:
1) The practice of undivided share of joint owners in a property should be banned.
2) At the time of purchase of property, if the property is being bought in joint names, each owner's clearly divided share in the property on map as well as in writing should be registered. Also, registering nomination details of the new owner(s) (buyer(s)) should be mandatory. In case of more than one nominee, each nominee's clearly divided share in the property on map as well as in writing should be registered. Nomination deatails should be kept confidential.
3) In case of all existing properties (even if not being sold) having joint ownership, it should be made compulsory for the joint owners to decide and register clearly divided share in the property on map as well as in writing. If they are not able to decide themselves, the government should divide their share on the basis of a predetermined criteria and register it.
4) For owners of all existing properties (whether individual or joint), registering nomination details of the owner(s) should be mandatory. In case of more than one nominee, each nominee's clearly divided share in the property on map as well as in writing should be registered. Nomination deatails should be kept confidential.
5) After death of any registered owner, his/her share in property should be registered in the name(s) of nominee(s) as per nomination details and at the same time, nomination details of new owner(s) should be registered. In case of more than one nominee, each nominee's clearly divided share in the property on map as well as in writing should be registered. Nomination deatails should be kept confidential.
6) Owners should have an option of changing their nomination details anytime.
This will end property disputes and bring peace in the lives of many people as well as reduce the burden on courts.

What will happen to Legal heirs if nominee takes away the property and sells it, again the court gets involved. Over all the suggested procedure is welcome but with some modifications. At the time of buying any property, the purchaser must mention his Legal heirs to whom the property should go. This will avoid writing a WILL, going to court for Legal Heirs certificate which involves lots of expenditure and time and helps in easy Mutation in Municipal corporations records and avoid corruption.

If you see developed nation they follow ISO method even for building infrastructures like road, house whether residential or commercial, Indian government must implement the ISO system everywhere, yes at the same it may not be possible for government to implement the system for old buildings and house then for that type of issue i would suggest following points: 1) All the disputed issues must be resolved on fastrack basis. 2)Government must identify all the disputed properties and try to resolve in mutual understanding with the neighboring people. 3)ISO system must be implemented strictly wherever possible and people must be made aware with the implementation system and benefits of ISO system.

It will take Several years to decide share in joint prperty and legal cases will take ywars decide. Nomination does not mean nominy is is legal hair, it is only arrangement in case of death that person will take possession and then owenership will be decided as per laid law. It can be done by omly will. So this not solution.
