Shifting with completion certificate in society
Hello,
I have purchased a 2 BHK, Builder flat in sector Omicron 3, Greater Noida.
Society is ready(except facilities like club house etc), but builder is not getting CC (completion certificate) from Authority due to unknown reason to us(buyers). Even builder started giving fit-outs / possession without obtaining CC from Authority, however he got all necessary / required NOC from concern Govt., departments.
Is it safe to move in such society, w/o having CC!!
can someone guide to process further.

It is advisable to "move in such society, w/o having CC" else you may loose that also. It is clear that there is something which is NOT legal that is why even after having all NOC's (?????) by the Builder/developer the Authorities are not issuing the CC. You may not be aware of the same but the time will play it's role when it will to your knowledge. Moreover, once you had paid all the amount- having option to take any legal action/s there is NO point to forbid yourself not to occupy your OWN house/premises.

Write a letter to the concerned authority that without CC (completion certificate) from Authority & required NOC from concern Govt., departments. builder give us the handover and possession this is for your kind information and necessary action to avoid the future complication.

Write a letter to concerned authority, asking it the reason for not getting the CC. If no reply comes within 30 days of your letter, then write to Public Information Officer, a letter under Right to Information (RTI), to get you the information for not getting CC to your building.

There are two aspects here - one legal, another - practical. Answers on legal aspect have been provided already. However there is a practical aspect for those who have invested in buying the property and are still staying on rent. For such people, the urge to move into their own house would be very high and when they see other people moving into their own house, it becomes tough to stop yourself. Ultimately you need to reach the answer yourself. The builder cannot give you proper possession certificate but if the required facilities are up and working, you can consider moving there. However keep in mind the legal situation about what happens in case of mishap. Ultimately the decision has to be yours and needs to be informed one.
