Service Tax, Swatchh Bharath Tax, Education Cess paid on a rejected Invoice raised in June 2017

We had raised an Invoice on our client for a service performed by us and had paid all the Taxes viz: Service Tax@ 14%, Swatchh Bharath Tax and Education Cess there on. However, the Client raised a dispute and refused to pay and cancelled the PO issued. However, after negotiations he has agreed to pay for the services and has issued a New Invoice as on date and asked us to raise a fresh Invoice.
Now, we would have to raise a fresh Invoice and once again pay the GST @ 18% on the Invoice.
We would like to know how to pass the adjustment entries in our books for the Service Tax, Education Cess and Swatch Bharath Tax paid on the earlier Invoice.
We would be very happy and obliged if we are given the details for the entries to be passed to close the old invoice in our books. more

Our CA said that we would have to forego the Service Tax paid. I do not think that is a correct answer and I request people/CA's/GST consultants in this fourm and even the GST department in the Government should give examples on how to claim back the Service Tax paid earlier should be claimed under the GST regime when the Client refused payment of the Invoice for whatever reason. I think I owe an answer from experts in this forum which would help many others in a similar situation like me. more
Sri. Nagarajan Chidmbaram, tax consultants are like that. They just blindly follow the rules rather than question the rationale of the law/rule/procedure. They probably afraid that their CA licences would be revoked.

For what you had experienced, it appears like double-taxation. There must be a mechanism for refunding the taxes you paid for service not provided. It is a pity that your CA advised that you should forgo the taxes you paid twice.

Our government at work... more
