Misleading Ads for Drugs

Seems like some of our efforts through local circles are seeing light of the day. For example Deceptive drug advertisements now face Rs 10 lakh penalty and 2 yr jail term for promoters, according to the proposed amendments to the DMR Act. Definition of advertisement to be amended in line with Consumer Protection Act. Reporting.

Consumer Affairs should act such that it happens in all industries including real estate, auto, food items and several other industries more

There is no dearth of acts/rules in our country. But what about their applications? Plenty of rules are their against violations traffic rules - cases of violations are increasing day by day. Law enforcing authorities either connive with such offenders or prefer to remain passive spectators. more
We badly require such stringent penal measures in all spheres of edible things for human consumption with strict enforcement of the law like the US Food and Drug Administration. But in India it is just the mockery of justice where hundreds of kilograms of spurious sweets prepared with highly perilous chemical ingredients during Diwali celebrations, that too in the national capital of Delhi and the states of Bihar and Uttar Pradesh, are reported every year in the media but nothing happens or no one is punished. So it is just an eyewash, as the penal provisions are not enough , it is the procedural matters that should be looked into first. For that the angle of jurisprudence has to be changed for this particularly sensitive segment. The accused must prove that he/she is not guilty, when caught red-handed, instead of the state bearing the liability to prove his/her guilt. Just imagine the ridiculous fact. If you shoot a person and kill him, you are liable to be prosecuted for that offence under Sec.302 of IPC that bears a death penalty. But if you kill a hundred persons by feeding spurious delicacies, expired medicines, adulterated food, you get a few years in jail. The return is lucrative in thousands of rupees. So who cares? more
