Luggage Misplaced: court makes Jet Etihad Pay Rs 1.25 lakh

This judgement needs to be used as benchmark for all delayed luggage cases. Consumer Ministry please take lead and make it happen. 1.25 lakh for 3 days delay means 40000 per day. No luggage will get delayed automatically.

Jayanthi Rajvi, had flown to Zurich in Switzerland for quick getaway. However, once she arrived in the country, she found that her bags weren’t there. She waited for two hours for luggage that never came. She later complained with Etihad Airways but the response she got was unsatisfactory.
Rajvi did not get anything but 35 Swiss Franc for expenses. Since she had none of the clothes she had packed for her six-day stay, she depended on her friend’s wardrobe, Rajvi told the forum. It was only after the vacation had ended, and when she came back to Hyderabad, that Rajvi was given her luggage back.

Meanwhile, the airlines said that the passenger had not performed a valuation of the luggage.

Representatives of Etihad argued they gave 35 Franc as mandated by the Montreal Convention since no valuation figure was provided. Jet Airways also said Rajvi could have fraudulently transferred the contents beforehand. However, barring all allegation, Consumer Forum - 3 said there was deficiency in service. It ordered the airlines to pay $1,500 at `69.85 per US Dollar and another `20,000 towards court charges. more

Excellent judgement of the Consumer Forum. However, unless and until the Airlines concerned have not challenged the said order in the State Commission or it has already been implemented by them, one cannot take it as a final verdict please. Therefore, if anyone has information that the Forum judgement has already been adhered to by the Airlines, kindly share that too. more  
I agree with Pradeep K Jain.We had also faced similar problems and my friend had to borrow my cloths. more  
Jayanthj Rajvi is Winner.Congrats. Can you eloborate the steps taken to get this verdict.Normally one of the area The Airlines give least attention is Luggage delay or lost.But they they take more attention while receiving the Luggage. It would be better to all to share more on this . Others can refer this and also the precuations to take in advance. more  
The valuation they never asked while checking in the baggage. Surprise. more  
It is very important to understand that Value of luggage is only one aspect - more important, disturbing and enervating fact is that you are without your wardrobe and other essentials at a foreign land and your vacation is spoilt for none of your doings. Compensation should be demonstrative for the mental agony caused. more
