In a DV family suit, a wife gives a complaint that she was threatened and beaten by her husband and in-laws in a specific area/location. However real fact was her husband was in a different place and his parents were in another place on that day. How to prove this, Can mobile phone calls made by them can show their respective location? It is really disheartening such unethical allegations are made against senior citizens (75 years)who requires support to walk/travel independently? Kindly advice more

Dear Mr. Ramesh my advice - since you have not mentioned your location I am just assuming you are in a metro 1 The best advice (consultation ) is to go a a good lawyer 2. They shall give you the best advice - cost would be approx INR 3000-5000 for a 1 hour consultation - some good lawyers would not charge you as you are a senior citizen ( their goodwill) - do speak to atleast two different lawyers - make a note of what you need to ask and what they would tell you 3. as a assurance I can tell you 4 recent cases in Delhi were in favor or men - as rightly posted by Suraj however the laws are tilted in favor of women (even lawyers would tell you ) 4. a lot would depend on several facts like the years of marriage, your son's background including professional background, children etc. all the best more
