Legal and Judicial System Issues – Inputs Required on Root Causes
1. There should be a careful and strict scrutiny and consideration to see is the legal case filed by the litigant has a good case needing justice. Many of the cases are filed to harass and extract money or favors from the opponents. This will cut short the number of cases and will lead to quicker justice. JUSTICE DELAYED IS JUSTICE DENIED.
The simpler cases may be sent to Arbitrators for resolving in time bound manner. All retired judges and advocates should be made eligible to become Arbitrators and should be appointed to hold courts in their areas. Their judgements may be sent to regular court for scrutiny and orders.
The number of working days and hours of the courts should be extended to clear the pending cases in a time bound manner. The summer and other vacations (the British style of holidays) should be scrapped. India cannot afford this legacy of British rulers.
Adjournments should be a rare event and should be allowed with heavy costs. In case the judge is on holiday the case should be heard by a vacation judge and routine matters may be disposed off.
