Legal and Judicial Reforms - Addl Inputs

There is no second opinion that more number of courts should be opened and more judges appointed. But it is well know fact that court are fully engaged with political cases and due to this the public cases could not be taken up in spite of the fact that many are very urgent, many litigants are Elders and some on death bed. Hence in each State, courts should be designated specially for dealing certain types of cases, (there are already courts for Criminal and Civil cases) namely,1. political cases (even election related cases) ,2.Abuse of Elders, Women,Children, and Physically handicapped and atrocities done to them, economical Offences (all cases related to money fraudulence etc will come under this), 4.Mafia cases (sand mafia, water mafia, Granite mafia and other similar cases) , 5. Cases filed against Government, PSU,Corporations (including P.S.Corporations, Boards, etc), and like that. Unless this is done political pressures would consume most of court time and cannot render justice to general public. more

Apart from opening more courts & adequate judges, time limit to be set to complete each case. No case can prolong more than the time limit. If prolonged the judge must explain the reason & hold concerned responsible. Some agency should be there to monitor the cases & results. If the order passed by a judge is reversed by higher court it must be thoroughly investigated why the order is reversed. the erring judge must be taken to task for delivering wrong judgement. more
Similarly , the long pending most important constitutional issues are to be Legislated which will have an altogether address. 1. Uniform Civil Code ;. 2. Cast , Religion , Minority based Benefits and Reservations shall be set Economy based strengthening the pre application advised by the Supreme Court through an address of Creamy layer . 3. Equality or Equal application of economic benefits to citizen shall not be at the cost of the Poor & poorest of Poor like LPG Etc., . The amount of such subsidies/grants to those above an arrived Economic status recognizing the second slab of income tax shall be rooted to those below the Poverty line . 4. Think and apply properly the Supreme court judgement on Reservations etc., to the Children of I.A.S. & I.P.S. AND THOSE ABOVE RS. 10,000/- that was recognized at the year of this Verdict in the case of Bihar etc., FOR ACHIEVING ALL THESE , THE LEGISLATURE HAS TO BE EMPOWERED TO LEAD THE FIT & THE EXECUTIVE HAS TO BE PATRIOTICALLY PRINCIPLED. more
1. You are correct in suggesting the best technical remedy for fast address of justice . The anticipated meet of Judiciary & Executive I think is still awaited. The Judicial reforms concluded through these circles also awaited for its adoptance . 2. The issue of No. of Courts & No. of Judges is also the prime & TOP MOST IMPORTANT & FACTUAL root cause . 3. A set aside of this only is the root cause of the existing pending cases in all the courts being purposefully maintained to escape from the resultant effects . Let us not forget the number of cases on political leaders & their supporters . The case of Sri Laloo Prasad Yadav is the fit example for the proof that this such attitude is selected by the Ruling party of these decades ; and the defy and deny of the Congress party about disqualifying the convicted candidates even at the direction of Supreme Court will also prove if the time gap of the case verdict is thought with comparison. There is absolute need to address both = 1 & 2 besides fit law enforcement & implementation forces more
