Judiciary needs selection through competition
The judicial system is held to ransom by a powerful lobby of legal luminaries who feel threatened from the transparency in judicial system. The judicial system in the country needs change with the Panch parmeshwar selected through competition in a transparent manner.
When ever a person completes degree in law, he tries to start his practice. Many lawyers succeed in the profession and become successful. They do not want to take up the paid job of judicial officer/ judge. Those who fail in the legal profession try to apply for the job as Judicial Officer/Judge at the lower level. By dint of hard work or seniority they get promotion to higher level. But the inferiority complex vis a vis successful professional lawyers remains.
In India, we have NDA Exam for direct recruitment of young Army Officers through national competitive examination. We have civil service examination for selection of best Officers in civil service, we have very tough examinations at all India level for selection of best students for medical profession, Engg profession, Chartered Accountancy etc. Unfortunately there is no All India level test for judicial services for selection of best professional judges, who can stem the rot in judicial system. Why can't we have a system where in best students are selected for judicial services after 12th Standard or after passing LLB through All India Competitive Examination? They can be trained to be efficient judges who do not have a handicap of inferiority complex. Whether law fraternity will allow this revolutionary change?
In every case before the honorable courts for selection of candidates for promotion, they demand that there sould be transparent system of selection duly notified. the promotions are nullified if proper and transparent system is not adopted. How ever for selection and promotion of honourable judges there is no transparency for the selection and promotion. An honourable judge who is not promoted will never know why he has not been promoted and what is expected from him to get a promotion.
Unless things change in our judicial system, common public has to suffer. more

वास्तविक दिक्कत तो यही है क्यूंकी न्यायपालिका जजों की नियुक्ति को पूर्ण रूप से अपने हाथों मे रखना चाहती है जो किसी भी तरह से सही नहीं है पर ऐसा हो रहा है और इसके लिए कार्यपालिका से उसी तरह व्यवहार कर रही है जैसे विपच्छ ? न्यायपालिका मे नियुक्तिया बाहरी एजेंसी द्वारा compatition पर आधारित हो एवं जज भी जिम्मेदार हों लंबित मुकदमों एवं गलत निर्णयों के लिए जिन पर ऊपर की अदालतों द्वारा रोक लगाए जाते है । more

THE ALLAHABAD HIGH COURT HAD, ON APRIL 2Oth 2016, REMOVED 15 "TAINTED" DISTRICT COURT JUDGES FROM THEIR JUDICIAL POSTS T SEEK. DOES THIS MEAN THAT ALL OTHER JUDGES ARE UN-TAINTED ?? OF COURSE NOT. CORRUPTION IN THE JUDICIARY HAS BECOME ENDEMIC AND IT IS HIGH TIME THAT EACH AND EVERY JUDGMENT OF EACH AND EVERY JUDGE , BE SCRUTINIED CLOSELY . IF THERE ARE A DEARTH OF JUDGES , WHY NOT APPOINT MORE AND MORE RETIRED JUDGES ?? WHY NOT THE CENTRAL GOVT. CONSIDER POSTING RETIRED "QUASI-JUDICIAL OFFICIALS " FROM THE CIVIL SERVICES , TO GO THROUGH EACH CASE AND DRAFT JUDGEMENTS , SO THAT THE CRORES OF PENDING COURT CASES BE REDUCED ?? IF THE BJP GOVT. HAS THE POLITICAL WILL IT CAN CLEAN UP THE WHOLE SYSTEM BEFORE 2019 .NEARLY ALL THE ABLE BODIED SENIOR CITIZENS ARE WILLING TO HELP THE CENTRAL GOVT. IN DISCHARGING ITS DUTIES TOWARDS THE CITIZENS . IS THIS NOT THE TRUE SPIRIT OF DEMOCRACY ??? I INVITE ALL RIGHT-THINKING PERSONS , TO COME FORWARD WITH THEIR CONSTRUCTIVE SUGGESTIONS TO MAKE THIS DEMOCRACY STRONGER . THE PREVIOUS REGIMES WERE LEAST BOTHERED ABOUT THE FUNDAMENTAL RIGHTS OF THE CITIZENS , GUARANTEED IN THE PREAMBLE TO THE CONSTITUTION . THESE FUNDAMENTAL RIGHTS WERE EVEN ABROGATED DURING THE EMERGENCY . IT WAS THE ALLAHABAD HIGH COURT WHICH DECLARED THE ELECTION OF ONE PREVIOUS PRIME MINISTER , BELONGING TO THE DYNASTY , AS " UN-CONSTITUTIONAL" WE NEED MORE GOOD JUDGES FROM THE ALLAHABAD HIGH COURT , IN THE SUPREME COURT COLLEGIUM . There are some norms for advocates' fees. But in case of a consultant fixing fees is not possible nor desirable. However what must be don't is to see to it that bar council de-registered the lawyers who deceive the client or the Judiciary. That is not the case at the moment and one Supreme court advocate involved in fixing perjury to save an admiral's son is again practicing now, even after his misdeeds were caught on camera and he was only given a rap on the knuckle only because he was former spokesperson of a political party. more

Advocates squeeze the clients and make huge money where as paid job gets even 1% of the unpaid job. Why advocates fee not fixed. Is it necessary the service of an advocate to the clients. No where in the constitution stipulates to engage an advocate. Advocates charge fees more than like cancer patient fee. Avoid advocates just like removing cancer parts from the body more
