The Preamble to The Consumer Protection Act, 1986 reads, "An Act to provide for better protection of the interests of consumers..." but in practice, except some cases reported in news papers, the protection is not provided to the interests of consumers. The cases are long drawn, dates readily given at the instance of the vendors and ultimately many deserving cases of the consumers are dismissed on flimsy/ technical grounds for the reasons which are understandable. e.g. consumers are generally weaker sections as compared to vendors. I have come across the cases where the Distt. Forum officials on contract basis have even forged and tempered the records to unduly favour the vendors and got away by the time of decision in appeal. Ready to submit the evidence of forging/ altering of record by such Distt. Forum Officials. Therefore, need a legislation to fix the accountability of such Distt. Forum Members and appoint an authority and give jurisdiction thereto to receive the complaints against such members and punish them for such misconduct/ offences. more
I fail to understand the insistence of Consumer Grievance Redressal Fora to follow the procedure laid down by CPC while filling and pleading a consumer complaint. The Consumer Grievance Redressal Act is primarily meant to help an average person and a person should be able to plead his complaint before a Consumer court without the help of an advocate. Unfortunately that is not the case at present. more
Dr, Sekhar Iyer, can the law enforcing agency and the consumer courts , every week release the press note thru out the country both on electronisc and print media, that how many complaint sor cases recived and how many are punished and how many are under progress and how many gone scotfree due to mal practices or due to misinterpretation, in the consumer interest? Thank you Mr.FATEH CHAUHAN your post on the consumer forum is most informative on the ground reality . Being a Supreme court advocate you can lead us on the legal aspects . When we summarize the causes * the first comes greed for money in other words corruption. What can a common man do when justice is purchased . So even the judiciary should be under a scanner whether corruption runs in our D.N.A. or not. * Delay in justice or unjustified postponement . Once again favouring one of the parties. There should definitely there should be a time limit [now in certain cases the judges stipulate in cases that are long overdue and send arrest warrants.]The erring parties should be served arrest warrants if unjustified postponement is sought. * The judiciary should also work like the officers like the I.A.S. I.P.S . and other Government staff with 70 Holidays in a year . 52 sundays and 18 public holidays and other mandatory leave facilities. This will straight away boost the working hours several fold ; as there will be continuity in the absence of long holidays. While the personnel from services work so hard day and night during war, floods, cyclones , fire and other calamities why not Judiciary also pool in their resources to walk that extra mile to clear the pending cases. on war footing . All the departments work on war footing except this one . This department also should come forward to assist the nation in wiping corruption. * The respect given to the Profession should not be exploited to show arrogance towards civil society.
