Consumer Protection Act 1986

Amendment to Consumer Protection Act 1986I am in agreement with Mr. Sreekumaran that it is high time to amend the Consumer Protection Act 1986 suitably, to meet present day requirements and to really protect the consumers. My suggestions are: 1. all items costing more than say Rs.5 a piece should have the MRP printed on it. If sold in boxes of more than one, there should be covering which cannot be tampered for each item in the master pack with the price. 2. The name and address of the manufacturer should also be shown on it. 3. in case of perishable items, the date of mfr and expiry date should be shown on the covering. 4. Hardware, plumbing and other such items are sold at very inflated prices depending on competition near the place. Hence, the above details are very imperative. 5. Defaulters should be punished with increasing amount depending on recurrence and 50% of such fine should be paid to the Consumer as compensation. 6. Recruit local people of good standing and high integrity to the jury, instead of going for costly Forum. 7. Lay down rules for time-bound disposal. 8. In case of appeal by the manufacturer, the entire cost at reasonable cost should be reimbursed to the Consumer. 9. Defective and spurious goods manufacturer should be given deterrent punishment including canceling his license to mfr. 10. Publish the list of service providers falling within the ambit of the Act to educate the public. more

Before fixing the MRP a costing has to be approved by the government agencies. more  
It is not explained as to how marking of MRP is going to help the consumer. You take case of Bottled water. You have different MRPS marked on bottles from the same manufacturer ranging from Rs.18 to Rs.75, depending upon where the same is going to be sold. Similarly there is a practice of marking high MRP by the manufactureer. There is no solution to this problem unless there is some government regulation on pricing. more  
Now the consumer Protection is not giving good to the consumers.The Act when it iiiiiiicame in force the first years the Act was beneficial for the consumers. Why it is not beneficial now?The dragging of complaints in Forum more than 10 years or more is the first Reason.The CDRF should take immediate Action to settle the cases maximum 3 Months.Then the people will have faith in this Act.For this Two actions is needed one the CDRF should be initiated in all TALUKAS of India as per the cases.(2) Appoint fresh judges to CDRF, and state and National commissions.The newly selected or appointed judges will work hard and Justfully. Now the Retired Persons are coming,they are aged,and no interest to work and the JUDGES are worked in courts. The Consumer Dispute redressal Forums are courts. These are the peoples hope and action center for Justice.We can work for this CHANGE. more

M.R..P. : 1.The mark up price on goods should have some sound basis ; this should be laid down by the Government. This is quite evident as we see oils packed in 1 liter packs ; the M.R.P. in the pack says Rs. 94/= , billed amount is Rs. 84/= Now the customer goes happily without knowing what a profit mark up was offered to the dealer. This Rs. 10 parted to the customer by the reatailer is an indicator of the profit margin allowed . In this case this is to compete and bag the sale. Immagine without coompetition that amount can be netted by the reatailer / super market . 2. M.R.P. should be printed in indeilible ink ; should be visible and clear to the naked eye. There should not not be over stamping or price stickeres pasted to camouflage the original . 3. A general complain will be a cumbersome process to the consumer . So a palatform should be there for the complaints to be recorded on each specif product and retailer . A consolidated case can be presented at the consumer court . 4. There should be a mechanism throuh which the M.R.P. printing on the Medice and other product strips to make it readable and clear. In blister packs printing can be done only on one side . The other side should contain in bold visible letters primarily the generic drug and the strength , the price , the the company's name ; the address may take the backseat as far as the size of the lettes . Manufacturing & Expiry / use before dates: It is done in the pharma procts and food items fairly well . I n case of frozen perishable non vegetarian products , it should be conspicuous ; as it is very important to note how long after the manufacture is one consuming ,to avoid health issues. more
