complaining against a person without time/date
sir, this has happened with one of my friend,
An advocate has complain to police that a man has clicked photographs,with mobile phone, of his sister/mother at night and filed complaint after two months.( at that time my friend was not having mobile phone with camera & usually returns from work around 930/10pm).
What action police has taken at that time nobody knows.
Even the person against whom complaint was written was not aware.
Now the advocate has mentioned the same complaint (with diary no) to court in a civil suit.
RTI to police has revealed that this type of complaint was not there with them?
This has happened in oct 2013.
What should my friend do?
He is upset as Advocate is hampering his position in society.

MR.RAVI KAKKAR... SIR WHO IS THE JUSTICE OF SUPREME COURT WHO SAID THIS NONSENSE? HOW CAN HE DEGRADE A PROFESSIONAL ENGAGED IN THE FIELD OF LAW??? PL PROVIDE THE DETAILS .. YOU MAY CHOSE YOUR OPTION FOR MARRIAGE BUT CANOT DEGRADE AND WILL NOT ALLOW ANYBODY TO DO SO.

One Justice of Supreme Court who reached the position of Chief Justice once mentioned in a private conversation that the Lawyers are the most lawless people of the society. In fact, the only vocation I ruled out while looking for a suitable match and the family, for my children was that of Lawyers.

Dear Mr. Iqubal, The matter is clear, the advocate is only trying to settle his score with your friend. Let your friend boldly ( of course) let your friend also have bouncers with him and fight against the advocate, who is trying to establish his power as an advocate. Write a registered letter to Bar Council or Association in your area explaining the fact and allege the advocate is misusing his power.

Mr. Iqbal Singh, in this case the situation is very clear. Your friend needs to file counter suit and claim damages. Put everything on record indicating that this is personal vendetta. The problem that I see here is that maybe the goal of advocate is to cause your friend to spend money and once that has happened, he will probably withdraw his case, especially if there is any adverse observation from court. From the facts mentioned here, I frankly don't see significant cause for concern. The only consequence I see is the harassment for your friend and monetary loss, which won't be the case for advocate as it is his daily job anyway. The problem in India is that courts don't easily grant monetary compensation even in false cases, but your friend can definitely demand it.

PUTHUCODE ANANTHARAMAN sir, advocate has not mentioned time and date , advocate is taking advantage of his position and putting false civil suit with no proof or evidence as father of my friend has reported to authorities about encroachments and blocking of parking space and parking of two unregistered scooters with blocking of stairs leading to roof of the building and keeping his german shepherd dog at stairs and roof.
