Axe on NRI Husbands
We kept on debating Marital Rape. In the meantime, another draconian Law is set to be framed against NRI Husbands. Please refer to attached Cover Page story published by Mumbai edition of Hindustan Times today (18/09/2017).
It goes without saying, if this Law is implemented, will also be misused against husbands because there would not be any check and balances, as in case of other Laws such as 498a, PWDVA and HMA.
A good suggestion to Indian men could be, not to marry and if marry, don't give birth to a male child.

The Basic Question is Gender differentiation which carry the meaning in our day today life, though we cry for the equality. But this basic question is unanswered to the effect. The law to this effect is getting used by few. The ray of hope is that the Hon'ble SC & HC had recognized this to some extend.

While enacting such a law, the government must take all precaution measures to ensure that the provisions in the law are not put into misuse against the innocent husbands by the greedy and revengeful wives to meet their own goals. There must be provisions for stringent actions against the wives found guilty of harassing the innocent husbands to meet their own goals.

I like the post of Atul Jauhari (Technocrat) ji that "..... Whole mess is created by Advocates itself and one cannot keep changing advocates"... In this connection, let me mention that Gandhiji vehemently criticized two professionals of the British (western) system, viz. the legal profession and the medical profession. However, he did recognize that lawyers and doctors can be great help to the people, but they also have the power to perpetuate strife or promote indulgence among the people. Gandhiji criticized the legal profession because it teaches immorality, it is exposed to temptation from which few are saved, it is one of the avenues for becoming wealthy and their interest exists in multiplying disputes. Gandhiji criticized the physicians because they depute the people by feigning to make them healthy, as a result people do not take care of their health. Gandhi feels that doctors have almost unhinged us and encouraged us to indulge ourselves resulting in loss of control over our minds, deprived of self-control and becoming effeminate. .... Let me add, the method/ approach of the so-called experts/ professionals of other branches are also identical to this... So one should be very very careful for availing their services and also for creating newer and newer laws, which can be misused by the help and connivence of such so-called advocates, medical men, professional experts....

Why not bring Health Services and individual Advocates under GST? A press release 'In a decision taken in the 16th meeting of GST Council held on 11th of June,2017, the Council has decided to exempt individual advocates including Senior Advocates from GST registration.

Going by all these sort of discussions, it may be said that after achieving wealth, and loosing health of individual and the universe itself, we, human beings are at a cross-road. At this cross-road, there evidently, are all round instances and feelings of confusion, commotion, depression, fruitlessness, disappointment, hollowness of life, futile activities, dilemma, not knowing what to do or where to go, that one is on the verge of madness, suicide or death, etc. This is at the root of demands for many a social laws... most of which are prone to be misused..... Is there any method to find out and implement the opposites of confusion, commotion, etc...., which may be the best method for human welfare universally.....

Only resort lies with Lagistitutes to frame fool proof Laws and removing Loop Holes from existing Laws.

I don't think there is anything wrong with this law. I have been hearing and coming across several cases where NRI men come down to marry an Indian bride and after spending their honeymoon, return back with promise to arrange for wife's travel/documentation and then the lady is kept on hold and is at the mercy of the family who had no intention of sending her abroad. In many cases the men were already married to the foreign nationals - a quid pro-quo for green card or whatever permit to enable them to reside their and though they have a family overseas they want an Indian bride too so that during their visits to hometown also they can continue to satisfy themselves. This is irresponsible and cheating - which perhaps this law would plug. Since men were aware of loopholes of our law, they took advantage of it, but now the vigilant law having been woken up by media has started taking a note of wrongs and evils to put a halt to it.

Secondly , the issue of marriage is increasingly becoming as a mere ceremony while the security and safety responsibilities of lifelong tie-up becoming side tracked . MARRIAGE MUST LIVE LIFE-LONG AT THE ONLY CONCEPT OF MORAL , ETHICAL AND SOCIALLY SECURED SAFETY OF WOMEN IN THE SOCIETY .
This is why , even Divorce is so restricted while the cruelty within is set for counselling , warning and punishment of an year to either reinstate or wholly decide for disperse .
