Cheating by Tata Housing

I am an academic and this is regarding cheating by Tata housing. I saw the advertisement on internet regarding a housingproject in Goa(code name: Rio De Goa) which showed a 360 degree view of a flat. As I was interested in having a retirement home in Goa, I made the online payment of the token amount of worth Rs. 30000/- for a duplex. As the advertisement was from a reputed company such as TATA Housing, I had no doubts about the security of my payment.

Later on I was contacted by the company and I was informedI will have to sign a pre-rera agreement which I refused to sign. As this information was not given to me at the time of payment of token amount, I felt cheated. As far as I know, this is illegal to be asked to sign an agreement which is essentially against the customer.

Furthermore following information was also not given to me:

(i) detailed layout plan of the apartment,

(ii) detailed layout plan of the location of 14 tours and
amenities provided in the complex,

(iii) details of building material to be used in the bathroom,

(iv) details of electrical wiring etc,

(v) a fixed date on which apartment will be delievered.

I requested the person in charge to immediately refund my token amount as I cannot go ahead with a project in which cheating is involved from the very beginning. I repeat I was not informed beforehand that I will need to sign a pre-rera
form. I paid Rs. 30000 thinking that Tata Subsidary will give me a fair deal. But their paperwork shows me that things are not even planned. As I paid due to misleading/ incomplete information on your web site, I asked them to refund my token amount of Rs. 30000. But they are refusing it on the ground that the token amount is non-refundable. It is pure cheating and that too by such prestigious company.

Be the developer X,Y or Z, without analyzing,studying all documents including developers liability,encumbrance and/or mortgage by consortium financers etc. are to be correctly interpreted through authentic documents, failing, a buyer becomes a victim of deal. more

Such malpractice has become a norm in this regime. It's everywhere. Private players have to recover from common people what they have funded in last couple of years for varied reasons. Regulators are always in silent mode. So no expectation from such rulers of the time. more
